NOTICE:

It is the obligation of the permittee, owner, operator or designee to ensure that erosion and sediment control Best Management Practices (BMPs) are installed in accordance with the site’s Erosion Control Plan (ECP) and installation design detail prior to commencement of grading, excavating, or stockpiling. BMPs must be maintained and functioning as designed at all times and until such time the site has been stabilized.

The permittee, owner, operator, or designee expressly grants the City irrevocable permission while the permit is active to enter the site described in this application, to inspect the property, and provide necessary erosion and sediment control if the permittee fails to do so. The City may draw on the collateral to reimburse costs incurred, including a 50% administrative and inspection fee. Any security or portion thereof withdrawn by the City must be replaced in full prior to work commencing again on the site, and if payment is not made, a Stop Work Order issued until funds are replaced. The erosion control collateral will be held by the City until the site has established vegetation sufficient to eliminate any potential for erosion as determined by City staff.

Failure to obtain an approved Site Development Permit prior to beginning any construction activity or land clearing can result in the issuance of a stop work or a fine until a permit is issued.

The Following Conditions Apply:

The Permittee shall:

  • Comply with City Code Article III, Section 50-52 through 79.
  • Install erosion and sediment control BMPs prior to beginning work on a site.
  • Schedule an initial inspection with City Municipal Inspection staff prior to any land disturbance activities.
  • The maximum area of earth disturbance at any one time is sixty (60) acres.
  • Implement the erosion control plan and stormwater management plan, if applicable, during construction and until it is determined by City staff that the site has achieved adequate stabilization.
  • Conduct inspections in accordance with the State Construction Discharge Permit inspection guide lines at a minimum of every 14 days and within 24 hours after any precipitation event that results in surface eroision.
  • BMPs requiring maintenance, repair or replacement must be corrected as soon as possible, immediately in most cases.
  • Install additional measures when there are changes in the site conditions, BMP ineffectiveness, or BMP failures.
  • Perform temporary or permanent stabilization within 30 days to areas at final grade which will not receive landscaping or areas that will remain dormant / inactive for more than 30 days.
  • The Stormwater Management Plan (SWMP) and ECP are living documents and must be revised/updated as site conditions change and when changes are made on site.
  • Request a final inspection when the site is adequately stabilized.
  • Temporary BMPs must be removed before the Site Development Permit can be closed.

In the event a permittee sells, conveys, assigns, dedicates or otherwise effectuates a change in ownership of all or part of a site, subdivision filing, or lot that is subject to a valid Site Development Permit, the new owner of the site, subdivision filing, or lot, or an authorized representative of the new owner shall obtain a separate Site Development Permit.
